MAINE STATE GOLF ASSOCIATION RELEASE, WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT RELATING TO COVID-19 VIRUS

 

The Maine State Golf Association (“MSGA”) seeks to reopen its golf operations while MSGA players want to start playing in MSGA events, including weekend, play days, and championships events (“MSGA Events”). Although businesses and recreation facilities across the state are beginning to reopen, the threat of Covid-19 infections will still be high for the foreseeable future, even for outdoor activities such as golf. The undersigned, knowing the risk, seeks to play in MSGA Events. The MSGA requires the following agreement to be read, agreed upon and signed by each participant in an MSGA Event to address the Covid -19 risk (Please note boxes that must be checked off in several sections below).

 

 

1. Neither I nor any of my household members 

 

a.) have knowingly been exposed to anyone diagnosed with COVID-19 within the last 30 days;

 

b.) currently have, or have experienced any of the following Covid-19 symptoms within the last 14 days: fever 100°F or above, fatigue, dry cough, sore throat, difficulty breathing / respiratory issues, chills, muscle pain, headache, loss of taste or smell; 

 

c.) have traveled outside of the country, or to any state outside Maine within the last 30 days, or if I or we have, I have self-quarantined at home for at least 14 days and remained symptom free throughout that period of time.

 

d.) have been diagnosed with Covid-19 or if I or any of us have, we have all been cleared as not contagious by an authorized state or local health authority  

 

 

2. I agree to notify the MSGA if I or any member of my household experience  any Covid-19 symptoms following the date I sign this Agreement, immediately upon experiencing any Covid-19 symptoms, I will withdraw before or during any MSGA Event until cleared as noncontagious.  

 


 

3. I have read the MSGA’s Covid-19 Code of Conduct, agree to abide by it and acknowledge that the penalties contained therein include a general penalty and the penalty of disqualification.  

 

 

 

4. I have read the current Maine CDC health guidelines and the rules issued by the Maine Governor’s office for reopening the Maine economy, including the Governor’s Office’s specific guidelines and rules dated May 27, 2020 that apply to golf. I agree to adhere to them at all times while participating in any MSGA Event as they apply to me and as they may alter or be modified in the future. State COVID-19 Guidelines for Golf 

 

 

5. I understand that the threat of Covid-19 infections will still be high for the foreseeable future, even in outdoor activities such as golf. I understand that exposure to the invisible COVID-19 virus, whether to contaminated surfaces or to people, involves risk that could result in illness, permanent disability or death. I understand that the MSGA is unable to protect me from such exposure and that I am responsible to exercise precaution to protect myself.  I accept all hazard and risk illness, personal injury, death or disability to me and or persons in my household caused by exposure to the COVID-19 virus at any MSGA Event, whether by personal contact with any other persons, contact with contaminated surfaces or otherwise, or negligence of others in any way associated with an MSGA Event or the golf course at which it is held.  

 

 

6. I release, hold harmless and forever discharge the MSGA, its officers, directors, employees, contractors, agents, volunteers, members and affiliates from any and all liability, claims, losses and expenses relating in any way to my exposure to or contraction of the Covid -19 virus at or in connection with any MSGA Event, including all claims, losses and expenses arising directly or indirectly from or attributable in any legal way to any negligence, act or omission to act of any such persons or the MSGA in connection with organization, administration or conduct of any MSGA Event. I also waive and promise not to sue the MSGA or any such persons on such claims. This hold harmless, covenant not to sue and release specifically includes without limitation, any and all claims that the MSGA or any of the referenced persons was negligent or careless in any way resulting in claims of personal injuries, death, property damage and other damages attributable to the Covid-19 virus.
