Assumption of Risk and Waiver of Liability for Communicable Diseases Including Coronavirus/COVID-19

The coronavirus, or COVID-19, has been declared a worldwide pandemic by the World Health Organization.  COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact.  As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Oceanside Country Club (OCC) as host of the South Atlantic Ladies’ Amateur Championship (The Sally), has put in place preventative measures to reduce the spread of COVID-19; however, OCC cannot guarantee that you will not become infected with COVID-19.  Further, attending and/or participating in The Sally tournament and/or events could increase your risk of contracting COVID-19 and other infectious diseases.  While rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.

In consideration of being allowed to attend and/or participate in The Sally tournament and/or events, attendees acknowledge and agree that:

1.            Before participating in and/or attending The Sally tournament and/or events, I agree and affirm that: (a) I do not have any fever, cold, or flu; (b) I do not have any other contagious virus, illness, or other infectious disease; and (c) I have not been in contact with anyone who has a contagious virus, illness, or other infectious disease within the last four weeks prior to any such attendance or participation.

2.            While attending and/or participating in The Sally tournament and/or events, I agree and affirm that I shall strictly observe and follow all health rules and protocols of the Centers for Disease Control and Prevention, the Florida Department of Health, and OCC, including, without limitation: hand washing, maintaining a minimum distance of six (6) feet from any other person, and using only my own equipment.

3.            On behalf of myself, my heirs and personal representatives, I knowingly and voluntarily waive, release and discharge OCC and The Sally and its affiliates, employees, managers, members, directors, officers, agents, volunteers, and representatives for any and all claims, causes of action, injuries, and damages of any nature, including, but not limited to personal injury, illness, paralysis, death, and economic and/or emotional damage, resulting from, relating to, or caused by the presence of or transmission of any bacteria, viruses, or infectious diseases.

4.            I HAVE READ THIS ASSUMPTION OF RISK AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AGREE THAT I HAVE WAIVED AND RELEASED SUBSTANTIAL RIGHTS BY VOLUNTARILY SIGNING IT WITHOUT ANY INDUCEMENT. I further agree that if a court finds any part of this Assumption of the Risk and Waiver of Liability to be unenforceable, invalid or void as against public policy, the remainder of this Assumption and Waiver shall remain in full force and effect.
