AGREEMENT TO DISCLAIMER, EVENT RULES & PRIVACY POLICY
By paying the nominated entry fee to the LAKE CLAREMONT HOLE OUT BONANZA event hosted by The Golf Collective Pty Ltd, the entrant confirms that they have read and agree to the terms and conditions outlined in this disclaimer, event rules & policy document.
All participants must complete and sign the participant declaration form provided to them upon checking in to the event on the day. Failure to do so will result in the participant being unable to take part in the event. A sample of the declaration form can be found in the event portal under “Player Declaration Form”.
SIMPLE DEFINITIONS
EVENT: LAKE CLAREMONT HOLE OUT BONANZA hosted by THE GOLF COLLECTIVE
ENTRANT: Any individual who makes payment to enter the event via the registration payment link in the Golf Genius event portal.
SPONSOR/S: Entities/Individuals providing, but not limited to, support, facility, equipment, prizes and/or advertising material.
PROFESSIONALS: A Professional is defined as a person who is a current or former professional golfer, PGA, PGA of America, CPGA, EPGA, LPGA, PGA of Australia or PGA of New Zealand or who is a current or former U Sports or NCAA Intercollegiate Golfer that has played in a U Sports or NCAA Intercollegiate golf tournament within the past 5 years.
EVENT RULES
EVENT ENTRY DATES: Event start date & time and end date & time as outlined in Golf Genius event portal or Social Media Post (“Lake Claremont Hole Out Bonanza” event)
WHO MAY ENTER: Event is only open to Australian residents (except where outlined differently) with valid email address Entrants subject to all notices posted online including but not limited to Privacy Policy and Terms of Use. Entrants may need to provide proof of residency upon request. Professional, ex-professional and plus(+) handicap golfers are not permitted to win the major prize on “The Final Attack” hole.
EVENT OBJECTIVE: The objective of the event as outlined in Golf Genius event portal and social media posting.
EVENT ENTRY: Instructions for emailing and/or registering are included in the posts and e-mails. All entries must be received by date and time outlined in social media posts. For purposes of these Official Rules, “receipt” of Entry occurs when The Golf Collective servers record the Entry information resulting from contestants’ entry being completed through the Golf Genius portal. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by The Golf Collective for purposes of these Official Rules. Entry must be the original work of the contestant, must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person and must not violate any law. The Golf Collective reserves the right to disqualify any Entry for any reason, in its sole and absolute discretion. Odds of winning depend upon number of entries received.
“THE FINAL ATTACK” RULES
MAXIMUM NUMBER OF ENTRANTS: 40
HOLE NUMBER: 9
TEE: Competition Tee as marked by The Golf Collective
DISTANCE: 140m – no shorter. Distance is measured from tee markers to tee box.
HOLE-IN-ONE PRIZE: Value of sum insured as stated in the schedule provided to The Golf Collective by Ozprize & Weather Insurance Specialists Pty Ltd. ($30,000).
NEAREST TO PIN PRIZE: Titleist TSR3 Driver
ELIGIBLE ENTRANTS: Amateur players who are not professionals as defined in the simple definitions located at the top of this document.
NON-ELIGIBLE ENTRANTS: Professional golfers as defined in the simple definitions located at the top of this document.
JUDGING: “The Final Attack” hole-in-one contest will be filmed at both the tee box and green. Only shots taken during “The Final Attack” portion of the event are eligible for the major prize. Shots made on hole 9 outside of "The Final Attack" portion of the event will not be eligible for the major prize. It is the contestant’s responsibility to ensure that they take their shot whilst the cameraperson has the lens aimed at them to record the shot. Entrants will receive one shot each and shots must be taken one at a time by each individual entrant. Shots cannot be transferred to other entrants. No warmup shots allowed. If the club makes contact with the ball with the intent of hitting the shot, then the entrant must take that as their shot. No re-takes or second shots are permitted. The ball must land in the hole without the aid of external forces and have been struck by a golf club connected to entrant at the appropriate hole tee box. An event auditor will be present to confirm the shot was made in accordance with the rules outlined in this document along with those set out by the insurance company providing cover for the major prize. The entrant who’s ball ends up in the hole first (once confirmation is received), will be declared the final attack winner (“Winner”) and awarded the major prize in accordance with the schedule sent to The Golf Collective by Ozprize & Weather Insurance Specialists Pty Ltd.
NEAREST TO PIN: All 40 entrants in “The Final Attack” will have a shot at the nearest to pin prize. The shot must be made without the aid of external forces and have been struck by a golf club connected to entrant at the appropriate hole tee box. If the club makes contact with the ball with the intent of hitting the shot, then the entrant must take that as their shot. No re-takes or second shots are permitted.
HOLE OUT BONANZA 9 HOLE CHALLENGE RULES
HOLE IN ONE PRIZES: The major prize for “The Final Attack” is not in play during the 9 hole round. Each hole will have it’s own dedicated hole-in-one prize. To win a hole-in-one prize, the shot must be made in regulation during the 9-hole scoring round and a playing partner must be witness to the shot. Provisional shots are not eligible for hole-in-one prizes. The ball must land in the hole without the aid of external forces and have been struck by a golf club connected to the entrant at the appropriate hole tee box. An event auditor will be present to confirm the shot was made in accordance with the rules outlined in this document for any all hole in one prizes.
HOLE 9: Hole 9 is to be played from the front tees, not the competition tees that are set up for the final attack. The major prize is not active until “The Final Attack” commences.
NEAREST TO PIN PRIZES: Provisional shots are not eligible for nearest to pin prizes. The shot must be made without the aid of external forces and have been struck by a golf club connected to the entrant at the appropriate hole tee box.
PUTTING COMPETITION RULES
JUDGING: Entrants will get one shot to make the putt. Entrants are allowed to use their own putter. Entrants must putt from the spot that the event auditor selects. No practice shots are allowed. The ball must land in the hole without the aid of external forces. An event auditor will be present to confirm the shot was made in accordance with the rules outlined in this document. Any entrant who successfully holes the putt will then go into a putt off final. The structure of the final will be decided by The Golf Collective and will take place prior to “The Final Attack”. If only one person makes the putt in the competition, they will be declared the putting competition winner (“Winner”) and will win the associated prize.
CHIPPING COMPETITION RULES
JUDGING: Entrants will get 3 shots to make the chip. Entrants are allowed to use their own clubs. Use of a putter is not permitted. Entrants must putt from the spot that the event auditor selects. No practice shots are allowed. The ball must land in the hole without the aid of external forces. An event auditor will be present to confirm the shot was made in accordance with the rules outlined in this document. Any entrant who successfully makes the chip will then go into a chip off final. The structure of the final will be decided by The Golf Collective and will take place prior to “The Final Attack”. If only one person makes the chip in the competition, they will be declared the putting competition winner (“Winner”) and will win the associated prize.
CONDUCT; NO INTERFERENCE WITH OPERATION OF CONTEST: By entering the event, you agree to be bound by these Official Rules. The Official Rules are posted at https://www.golfgenius.com/pages/10107941245524424296 throughout the Contest. You further agree to be bound by the decisions of the prize Sponsors and The Golf Collective, which shall be final and binding in all respects. You are responsible for complying with all applicable federal, state, and local laws and regulations and with these Official Rules, and by entering, you agree to be bound to these Official Rules. You further agree to not knowingly damage or cause interruption of the event or to prevent others’ participation in the event. The Golf Collective’s decisions are final and binding.
WINNER NOTIFICATION: Winner(s) will be determined on the day of the event after the “The Final Attack” contest has been completed. Winner(s) will be required to provide mailing or emailing address which will be used to fulfill the prize shall it not be present on the day, they not be present to redeem it, or are unable to transport the prize after the event. At the discretion of The Golf Collective, Winner may be disqualified for any of the following reasons: if charged with or convicted of a felony or misdemeanour, is not eligible based on the eligibility requirements set forth above, or if delinquent on a government ordered payment, such as, but not limited to: child support, spousal support, alimony, tax payments, etc. In the event it is determined that the Winner has not complied with these Official Rules, has made false statements or is accused and caught cheating, then the Winner will be disqualified and at The Golf Collective’s sole discretion, the Entry with the next closest shot may then be declared the alternate Winner.
PRIZE & APPROXIMATE RETAIL VALUE (“ARV”): Number of winners, prize and ARV as outlined in social media posts and on the Golf Genius event portal. Winner is solely responsible for all expenses, costs or fees associated with transportation and acceptance and/or use of the prize not specified herein as being awarded, including without limitation, any and all taxes (if any). Winner is not a recipient of a prize until s/he has been verified as the Winner by The Golf Collective or auditor. Upon fulfilling handover of a physical prize or voucher, The Golf Collective will be deemed to have awarded the prize to the Winner and such Winner assumes full responsibility for the prize. All prize details are at the Sponsor’s and The Golf Collective’s sole discretion. Sponsor’s and The Golf Collective make every effort to ensure that prizes advertised are as close to prizes available on the day. Some prizes may vary in size, brand, colour, type, shape and value (ARV). Prizes are donated by the event Sponsors and The Golf Collective assumes no responsibility for incorrectly advertised and/or supplied prizes. For any warranty claims on prizes, winners are instructed to direct those claims to the prize sponsor. Prizes are non-transferable and may not be redeemed for cash. No prize substitution allowed by winner(s). The Golf Collective reserves the right to substitute a prize of equal or greater value for any reason in the sole discretion of The Golf Collective if the prize or any component thereof is unable to be supplied for any reason.
GENERAL CONDITIONS: Unexpected events beyond the control of The Golf Collective may cause the event to be rescheduled, modified, or cancelled. In that event, The Golf Collective reserves the right to, at its discretion, reschedule the event, entry and/or end dates, modify the entry procedures, cancel the event, or cancel the awarding of prizes. Prize(s) are not redeemable for cash. Winning constitutes permission (except where prohibited by law) to use Winner’s name, images, hometown, likeness, prize won, and photograph (all at The Golf Collective’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification or permission. Event Sponsors/Parties and their respective officers, directors, agents, representatives, and employees (collectively, “Released Sponsors/Parties”) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, or incomplete once prizes have been awarded and collected by entrants. CAUTION: Any attempt by a participant to deliberately damage any prize, part of the golf course, nearest to pin marker, tee box, green, hole or undermine the legitimate operations of the event is a violation of criminal and civil laws. Should such an attempt be made, The Golf Collective reserves the right to seek damages from any such event entrant to the fullest extent permitted by the law and to disqualify such participant from the event.
MISCELLANEOUS CONDITIONS: Failure to comply with these Official Rules may result in disqualification from the event. The Golf Collective reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules. Event is subject to all federal, state and local laws and regulations. Void where prohibited by law.
RELEASES: By entering in this event, entrants agree to The Golf Collective’s use of their personal information for both online and offline direct marketing purposes. For details and to opt-out, visit The Golf Collective’s Privacy Policy at http://thegolfcollective.co/privacy.
ARBITRATION & CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this event, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this event, or any prizes awarded, shall be resolved individually, without resort to any form of class action lawsuit, and exclusively by final and binding arbitration under the rules of the Arbitration Rules and Expedited Arbitration Rules and held at the ACICA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this event), and entrant (or, if an eligible minor, his/her parent or legal guardian) further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and The Golf Collective in connection with this event, shall be governed by, and construed in accordance with, the substantive laws of the State of Western Australia, Australia without regard to Western Australian choice of law rules.
WINNERS LIST: Winner(s) will be announced at the post round presentation following “The Final Attack” and will then be published on The Golf Collective website and social media pages.
PRIZE DISTRIBUTION: The Golf Collective will make every effort to ensure all prizes are available to take home on the day of the event. Some prizes may not be available to take home on the day. The Golf Collective will assume responsibility in making sure that the Winner(s) receives their prize(s) within a 30 day period following the event.
MAJOR PRIZE TAX REQUIREMENTS: Any applicable taxes not included in the sum insured are the responsibility of the Winning Participant.
AWARDING OF MAJOR PRIZE: The winning participant will be required to complete and sign Hole-in-One Final Claim Form and witnessed when signing. Verification of the full video documentation of the Event will be required prior to submitting the final claim form.
